Terms of Service

1. Agreement

These Terms of Service (the “Terms”) govern your access to and use of the TraccoAI website and software service (the “Service”) operated by TraccoAI (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

TraccoAI is currently operated by its founder as an individual sole operator while a formal commercial entity is being established in the United Arab Emirates. Once that entity is registered, these Terms will be updated to name the registered company, and that entity will be the contracting party.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for maintaining the security of your account and for all activity under it. We use passwordless “magic link” sign-in, so keep access to your email account secure. Notify us promptly at support@traccoai.com of any unauthorised use.

3. The Service

TraccoAI lets you add a brand, competitors, and prompts, then periodically sends those prompts to third-party AI assistants and analyses their responses to estimate how often and where your brand appears. Results are statistical estimates based on third-party AI outputs that change over time. We do not guarantee any particular ranking, appearance rate, or outcome. See our Disclaimer.

4. Subscriptions, fees, and billing

The Service is offered on paid subscription plans (currently Solo at USD 19/month and Pro at USD 49/month). There is no free trial. By subscribing, you authorise recurring charges for your chosen plan until you cancel.

• Payments are processed by Dodo Payments acting as our Merchant of Record. Dodo Payments is the seller of record for the transaction and is responsible for billing and the collection of any applicable taxes.
• Subscriptions renew automatically for successive billing periods at the then-current price unless cancelled before the renewal date.
• We may change prices or plan features on prospective notice. Changes do not affect the period you have already paid for.
• Refunds and cancellations are governed by our Refund & Cancellation Policy.

5. Acceptable use

You agree to use the Service lawfully and in accordance with our Acceptable Use Policy. You must not misuse the Service, attempt to circumvent usage limits or security controls, or use it in any way that breaches UAE law, including Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes.

6. Your content

You retain ownership of the brands, prompts, and other content you submit (“Your Content”). You grant us a limited licence to host and process Your Content as needed to operate the Service, including sending prompt text to third-party AI providers to run scans. You are responsible for ensuring you have the right to submit Your Content and that it does not infringe the rights of others.

7. Intellectual property

The Service, including its software, design, and content (excluding Your Content), is owned by us or our licensors and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, modify, reverse engineer, or resell the Service.

8. Third-party services

The Service relies on third-party providers, including AI assistant APIs, hosting, email, and payment providers. We are not responsible for the availability, accuracy, or content of third-party services, and your use of them may be subject to their own terms.

9. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We may perform maintenance that temporarily limits availability.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of results. Nothing in these Terms excludes any rights you have that cannot be excluded under UAE law.

11. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, or business. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the three (3) months immediately preceding the event giving rise to the claim. These limits do not exclude liability that cannot be limited under UAE law.

12. Indemnity

You agree to indemnify us against claims, losses, and expenses arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

13. Suspension and termination

You may stop using the Service and cancel your subscription at any time as described in the Refund & Cancellation Policy. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service unlawfully. On termination, your right to use the Service ends, and we will handle your data as set out in our Privacy Policy.

14. Governing law and disputes

These Terms are governed by the federal laws of the United Arab Emirates and, where applicable, the laws of the Emirate in which our entity is registered. The courts of the United Arab Emirates will have jurisdiction over any dispute, without prejudice to any mandatory consumer protections available to you under UAE law. Once our entity is registered, this section will specify the relevant Emirate and competent courts.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and change the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
